On December 5th, 2000 the Tulsa World in a report titled, "Skiatook girls tell of viewing themselves on video" detailed events on the first day of the preliminary hearing for Harry Red Eagle Jr. The hearing was held in Osage County District Court, in Pawhuska, Oklahoma.
Red Eagle was charged Aug. 24, 2000 with two counts of lewd acts as to a child under 16, one count of procurement of obscene material and three counts of attempting to procure obscene material.
Quoting from that report:
Two Skiatook High School girls Monday held humiliation at bay and their composure in check as they recounted viewing themselves in various stages of undress on a secretly taped video -- allegedly done by their basketball coach, Harry Roy "Noonie" Red Eagle Jr.
The girls are two of five Skiatook High School girls scheduled to testify in Red Eagle's preliminary hearing, which concluded its first day of testimony Monday in Osage County District Court.
The referenced report went on to indicate:
The two girls, now 17 and seniors, testified they were both 15 when the videos were taken during the 1998-1999 school year.
The first girl said she got a big surprise to find she was on the video.
The girl said she went with her cousin to the Skiatook Police Department to lend moral support after police asked her cousin to view the tape.
The girl said "you couldn't see the girl's face. I recognized my bathing suit bottoms" and a T-shirt she'd got at camp."
The video showed her taking off her bathing suit bottom and underwear. She said she was preparing to take a whirlpool treatment Red Eagle recommended after she'd pulled a muscle in track.
Choking back tears, she said, the video showed "my private parts from the back."
She said the video was stopped, backed up, put into slow motion with the camera zooming in on her backside.
On December 8th, 2000 Osage County Associate District Judge W.H. Mattingly ordered Red Eagle to reappear on January 8, 2001 before District Judge J.R. Pearman. Judge Mattingly said the evidence gave probable cause to believe that Red Eagle committed all six allegations.
The Tulsa World reported this development in the case in an article dated 12/09/00 and titled, "Former coach to stand trial".
Quoting from that report:
At the conclusion of Friday's testimony, Mattingly overruled an objection by defense lawyer John Briggs, and admitted the three videos into evidence.
Briggs argued the tapes should be omitted because the state failed to show a proper chain of custody. Too, he said, testimony seemed to vary as to what is on the tapes, indicating the tapes had been altered.
During Friday's testimony, a 19-year-old girl who graduated May 1999 said the portion of tape showing her was taken during the soccer season, sometime in March 1999.
The girl, 18 at the time, said the video showed her undressing and in the nude from the front and the back. She said there were two sequences, lasting a total of about five minutes.
The second victim, now 19, testified she was 17 when the video was made. She said she viewed all three tapes at the police station to identify herself and other girls on the tapes.
The first tape showed Red Eagle setting up the camera, and then about 10 minutes later, "I walked in. I was the first girl to walk in."
She said the tape shows her taking off her sweater, getting ready for basketball practice.
Testimony from the victims showed the videos were taken in the middle school locker room the high school locker room and the whirlpool area.
All of the victims were able to pinpoint the time of year and place the videos were taken.
On January 8, 2001 Osage County Judge J.R. Pearman set a trial date of June 16th for Harry "Noonie" Red Eagle on the six felony charges and continued Red Eagle's bail of $10,000 permitting Red Eagle to remain free until trial.
Prior to Red Eagle's trial date the Tulsa World in a report dated 6/08/01 and titled, "Former coach gets plea bargain" revealed the terms of a plea deal between Red Eagle and prosecutors.
Quoting from that report:
Former Skiatook girls' basketball coach Harry "Noonie" Red Eagle Jr. was handed 20 years of probation Thursday after pleading no contest to charges that he secretly videotaped girls undressing in their locker room two years ago.
Part of the agreement calls for a 20-year suspended prison sentence during which he will be on probation, officials said.
The referenced report went on to indicate that Red Eagle received the maximum on each of the six counts with which he was charged.
The report quoted Osage County District Attorney Larry Stuart as saying that the breakdown of the probation was as follows:
20 years each for two charges of lewd acts to a child younger
than 16
5 years for procurement of obscene material
2-1/2 years each on three charges of attempting to procure
obscene material./p>
The report also indicated that DA Stuart told the court that that he spoke to as many of the victims and their parents as possible prior to entering the agreement. And that while most were OK with the agreement, some were not so happy about it, and one couple disapproved.
The Tulsa World report also indicated that Red Eagle must pay $5,000 in victim witness assessment fees and court costs and that he must deliver to the prosecutor's office all photographs, videos and other media of all victims, known or unknown, who have been recorded in any manner without their knowledge.
Further quoting from the referenced report:
The plea agreement also states that Red Eagle shall not accept any teaching, coaching or other position or duty, whether paid or voluntary, that puts him in contact with children.
He must also register as a sex offender as required by the Oklahoma Sex Offenders Registration Act. If Red Eagle moves to a state without such legislation, he must then inform the law enforcement agency having jurisdiction over such cases.
The agreement also calls for Red Eagle, at his own cost, to undergo a psychological evaluation and an evaluation regarding his propensity for committing sex crimes. He must do that within 30 days of sentencing and follow the recommendation for treatment, if any.
At the end of Thursday's hearing, Red Eagle was remanded to the Osage County Jail until formal sentencing Aug. 10.
On August 11, 2001 the Tulsa World in a report titled, "Coach's sentence official" reported the on the conclusion of the case and the acceptance of the plea deal between Red Eagle and prosecutors by the court.
Quoting from that report:
After a year of silence, one of 24 students who were secretly videotaped by a former basketball coach, Harry Roy "Noonie" Red Eagle Jr., said in court Friday that she "wanted to die" when she saw herself on the videotape aired by a Tulsa television news program.
The former Skiatook High School student spoke on behalf of her fellow victims during a brief but powerful statement at Red Eagle's formal sentencing in Osage County District Court.
Friday's hearing before Osage County District Judge J.R. Pearman ended the yearlong ordeal that has forever changed the victims' lives, said the girl who spoke for the students.
She was joined by nine other victims who lined up before Pearman's bench while the statement was read.
Choking back tears, the girl told her former coach that he would never know the devastation his actions have caused.
"I feel like you raped everyone of us in your mind," she said.
In Red Eagle's written statement for the presentencing investigation, he admitted that he "regrettably placed a video camera in a locker . . . and caught some of the female students changing from their school clothes into workout clothes."
The Department of Corrections recommended a period of incarceration for Red Eagle, followed by an extended period of supervision. That recommendation was based on the nature of the offense, "the number of victims, the outrageous breech of public trust and the outrageous invasion of personal privacy . . . the offense represents," according to the presentencing investigation.
According to the presentencing investigation, Red Eagle plans to move to Dallas, where he'll seek employment with Avery Air Conditioning.

What follows is editorial comment on the part of the editor of Bubbaworld:
What's so striking about the final resolution of the Harry "Noonie" Red Eagle case is that in spite of the number of offenses, their seriousness and the harm done his victims Mr. Red Eagle walked out of the courtroom with twenty years probation. And this in spite of the Oklahoma Department of Corrections recommendation of "a period of incarceration".
Likewise it is the opinion of this writer that throughout the entire fiasco that the primary motivation of every government official involved was not seeing justice done but rather to see the scandal "go away" as quickly as possible.
It appears to this writer that every step along the way, the prime imperative has been "damage control", first by the Skiatook Oklahoma School Board when it fired the messengers, to the district attorney's office when it entered into the plea agreement and lastly to the judge which accepted that agreement in spite of the recommendation of the Department of Corrections.
What we saw in the case of Harry "Noonie" Red Eagle was not "justice", it was simply "damage control" and a hope that the story of Coach Noonie and His Hidden Camcorder would simply go away and soon. That's just the way some people are around here.
