A Question of Priorities #4
In this section of Bubbaworld we reveal examples of events which should cause a reasonable person to question the priorities of both Oklahoma's Criminal Justice System and those that control it.
Delaware County District Court, Jay, Oklahoma
DA of Record: Traci Cain
Judge of Record: Robert G. Haney
In October, 2004 Waylon Lee Burleson, age 19, of Grove, Oklahoma pled guilty in Delaware County District Court to charges of first-degree rape and forcible sodomy of a 12-year-old girl.
Judge Robert G. Haney ordered Burleson to spend one year in a treatment program in exchange for a deferred sentence on charges. Judge Haney ordered Burleson to enter Pure Life Ministries, a faith-based treatment program in Kentucky, for one year and set a review of Burleson's case for October, 2005. If Burleson successfully completed the treatment program he would then receive a 20 year suspended sentence, be put on five years supervised probation and be required to register as a sex offender.
On December 31, 2004 Burleson was released from the Delaware County Jail and entered a sex offender treatment program. He left the treatment program without completing it in February, 2005.
Following Burleson's exit from the treatment program Judge Haney sentenced him to concurrent 20 year terms on the rape and sodomy counts and for good measure tossed in concurrent sentences for his other convictions on counts of assault with intent to commit a felony against a 15-year-old victim, assault and battery on a police officer, trespassing after being forbidden and an assault and battery charge. All sentences to run concurrently, meaning that Burleson's sentence is 20 years. Burleson was also accessed fines, costs and restitution totalling over $6,000.
